Social worker suspended for failing to maintain professional boundaries

Social worker Lucie Emma Taylor has been suspended from the HCPC Register for a period of twelve months on grounds of misconduct and dishonesty whilst employed at Sefton Metropolitan Borough Council.

A panel of the HCPC Conduct and Competence Committee heard that Miss Taylor failed to maintain professional boundaries between October 2013 and January 2014, by engaging in an inappropriate relationship with Person B, the uncle of a Child A who was on her caseload.

The Panel further heard that Miss Taylor became subject of an internal investigation after admitting to her manager that she had not been truthful about the nature of the relationship with Person B.

Panel Chair Mr Donald Brown commented:

“Miss Taylor had been dishonest in concealing the extent and sexual nature of the relationship when speaking with her managers and during the employer’s internal investigation. In spite of her association with Person B she had continued to oversee the care of Child A, thereby, creating a potential conflict between the needs of Child A and any risk posed by Person B as a member of that family and household. Dishonesty is a fundamental breach of professional standards.”

The Panel concluded that a suspension of twelve months was necessary to protect the public. This would provide Miss Taylor with an opportunity to fully reflect and develop insight into matters that brought her before the hearing.

Social worker Barbara Marjorie Davis has been struck off the HCPC Register on grounds of misconduct whilst employed for Luton Council after a review of her HR portfolio, supervision records and training records raised concerns about her practise.

A panel of the HCPC Conduct and Competence Committee heard that failings included not completing care and / or risk assessments and / or closure summaries in a timely manner; not progressing a carer’s direct payment in a timely manner; and failing to undertake and or complete support plans in relation to multiple service users.

The Panel further heard that failings included not completing a risk assessment for Service User A in February 2012 with records showing that she had still not completed the risk assessment by the time Service User A had died in hospital on 18 April 2012.

Panel Chair Penny Griffith commented:

“The Panel considered that Mrs Davis consistently and deliberately failed to perform her duties as a registered social worker. The Panel was satisfied that failures to complete care and / or risk assessment and / or support plans by the required dates or within the required time frames was serious. It could potentially cause harm to service users and damage the reputation of the profession and amounted to misconduct.”

The panel concluded that the only appropriate and proportionate sanction in this case was a striking off order and directed for the name of Mrs Barbara Marjorie Davis to be removed from the register with immediate effect.

Social worker suspended on grounds of misconduct and dishonesty

Social worker Glenda E Gray has been suspended for a period of nine months on grounds of misconduct and dishonesty.

A panel of the HCPC Conduct and Competence Committee heard that on the 24 July 2008, Miss Gray applied for a post as a Social Care Manager with City of York Council (the Council) and stated on her application that her reason for leaving her employment at North East Lincolnshire Council was for a career break when in fact she had been dismissed.

The Panel further heard that the Council conducted an investigation into the allegation above following receipt of a letter from Person 1 which included a number of allegations against Miss Gray.

Miss Gray admitted the allegation at the commencement of the proceedings, and repeated the admission in her evidence with an explanation as to the circumstances which caused her to provide the incorrect information.

Panel Chair Helen Carter commented:

“The Panel noted that Miss Gray at the Council’s disciplinary hearing in 2013 and again at this hearing had denied that she was dishonest as regards her actions as set out on paragraph 1 of the allegation.

She has remained, both at the Council’s disciplinary hearing and at this hearing that all agencies she has worked with and all employers with whom she has been placed since 2013 are aware of her dismissal but she has provided no evidence of this. She had shown neither insight nor remorse. The Panel could not exclude the possibility that she had might act in a similar manner in the future”.

The Panel concluded that Miss Gray’s fitness to practise is currently impaired and directed that the name of Miss Glenda E Gray be suspended from the HCPC Register for a period of nine months.

Physiotherapist suspended for twelve months on grounds of lack of competence

Physiotherapist Alexander Fawcett has been suspended from the HCPC Register for a period of twelve months on grounds of lack of competence whilst employed at Medway NHS Foundation Trust (the Trust).

A panel of the HCPC Conduct and Competence Committee heard that that early in Mr Fawcett’s probation period, various concerns were raised by staff in relation to his lack of progress. Concerns included completing patient notes with illegible handwriting and spelling errors; failing to demonstrate clinical reasoning in patient records; failing to identify patient problems; failing to alter treatment plans according to patient needs; and failing to adapt his communication style to patient needs and raising his voice unnecessarily to patients.

The Panel further heard that as a result of the concerns not being remedied in the course of his probation period, the Trust referred Mr Fawcett to the HCPC. Mr Fawcett had engaged with the regulatory process and on the 6 March 2016 returned a signed Notice to Admit Facts to the HCPC

Panel Chair Sarah Baalham commented:

“The Panel was of the view that Mr Fawcett may be able to remedy his lack of competence, and noted that he expressed a wish to practise as a physiotherapist in the future. It therefore decided that a twelve month suspension was appropriate and proportionate sanction, which would protect the public and address the public interest.”

The Panel directed for the name of Mr Alexander Fawcett to be suspended from the HCPC Register for a period of twelve months.

The order imposed will apply from 2 December 2016 and will be reviewed again before its expiry on 2 December 2017.

Mr Alexander Fawcett was not present nor represented at the hearing.

Physiotherapist struck off following police caution

Venkata Naga S Syagamreddy has been struck off the HCPC Register after receiving a caution from the Durham Constabulary for an offence on 30 November 2015.

A panel of the HCPC Conduct and Competence Committee heard that Mr Syagamreddy was cautioned over the sexual assault of a female sixteen years or over – no penetration.

The Panel further heard that the incident took place whilst Mr Syagamreddy was working as a physiotherapist at a commercial gym, he was accused of assaulting the patient by placing his hands inside her bra and massaging her breasts for approximately two to five minutes.

Panel Chair Philip Geering commented:

“A striking off order is a sanction of last resort and should be reserved for those cases where there is no other means of protecting the public or the wider public interest. The Panel decided that Mr Syagamreddy’s case falls into this category because of the nature and gravity of his sexualised behaviour towards a vulnerable patient, his lack of insight and the high risk of repetition.”

The Panel directed for the name of Venkata Naga S Syagamreddy to be struck off the Register.

Mr Syagamreddy was neither present nor represented at the hearing.

Paramedic Richard C Moxon has been struck off the HCPC Register on grounds of misconduct whilst employed with North West Ambulance Service Trust (NWAS).

A panel of the HCPC Conduct and Competence Committee heard that on 28 and 29 November 2013 NWAS received complaints relating to Mr Moxon’s behaviour during his attendance at an emergency call at the home of Service User A. Allegations included behaving inappropriately towards the service user’s female relatives and returning to Patient A’s property unannounced the following day.

The Panel further heard that following an internal investigation into the complaint and a Clinical Review of the services Mr Moxon provided on 27 November 2013, some clinical matters were raised in respect of the Patient Report Form (PRF), which Mr Moxon had completed, and the care he provided. This included failing to record the correct time on the PRF and not acting in the best interests of Service User A.

Panel Chair William Nelson commented:

“The Panel had regard to the nature of the misconduct which included matters of a sexually motivated and inappropriate nature. In the Panel’s view this type of misconduct was very serious in nature and demonstrated attitudinal issues on the part of the Registrant.”

“For reasons including the risk of repetition, little or no evidence of insight and remorse; and the non-engagement with these proceedings, the Panel concluded that there was no other way to protect the public and to meet the wider public interest, than to impose a Striking Off order”.

The Panel directed to strike the name of Richard C Moxon from the HCPC Register from 21 December 2016 with an Interim Suspension to cover the appeal period.

Biomedical scientist Alfred A A Adio has been struck off the HCPC Register on grounds of his conviction of committing fraud in relation to his expense claims at Dartford Magistrates’ Court and misconduct.

A panel of the HCPC Conduct and Competence Committee heard that Mr Adio was employed as a Band 6 biomedical scientist based at Darent Valley Hospital. Following a discrepancy in his travel forms in October 2013 an internal investigation was initiated by the Hospital to review his expenses which found that he had made claims for journeys he had not made and for time he had not worked. The matter was then reported to the police.

The Panel further heard that Mr Adio was convicted on 18 December 2014 for dishonestly making a false representation, namely that he had submitted inflated and therefore false travel claims to his employer, intending to make a gain, namely payments in the sum of £918.84 in respect of travel costs that he had not incurred and was not therefore entitled to claim.

Panel Chair Jennifer Rogers commented:

“The Panel has no hesitation in finding that Mr Adio’s dishonesty in relation to these false claims was serious misconduct. This was not a single isolated incident, but was conduct which had taken place over the best part of a year.

To ensure the public’s confidence in the biomedical scientist profession and in its regulatory body, and to uphold proper standards of conduct and behaviour in that profession, the Panel has decided that it is appropriate and proportionate in this case to order that the Registrant’s name be struck off the Register.”

The Panel directed for the name of Alfred A A Adio to be removed from the Register from 27 December with an Interim Suspension Order to cover the appeal period.

Physiotherapist Stephanie P Howes has been suspended from the HCPC register for a period of twelve months on grounds of her conviction of fraud at Worthing & Chichester Magistrates Court on 8 March 2015.

A panel of the HCPC Conduct and Competence Committee heard that on 29 March 2016 Miss Howes notified the HCPC by letter that she had pleaded guilty to two offences relating to the false representation of timesheets.

The Panel further heard that Miss Howes was sentenced to an 18 week prison sentence suspended for 12 months an unpaid work requirement of 150 hours to be completed within 12 months.

Panel Chair Stephen Fash commented:

“The Registrant forged signatures on 14 timesheets and fraudulently claimed for 66 hours on seven dates on five different timesheet claims when she was not at work but off sick. Miss Howes’ dishonest actions resulted in an overpayment by the Trust. The Panel took the view that this conduct and behaviour breached a fundamental tenet of the profession a brought the profession into disrepute”.

The Panel concluded to suspend Miss Howes from the HCPC Register for a period of twelve months as this would be sufficient for her to demonstrate an appropriate level of insight into her failings.

The twelve month suspension imposed will apply from 30 December 2016 with an interim suspension order to cover the appeal period. The order will be reviewed again before its expiry on 30 December 2017.

Chiropodist / podiatrist struck off due to conviction

Maurice W McShane has been struck off the HCPC Register on the grounds of conviction whilst registered as a chiropodist / podiatrist with the HCPC.

A panel of the HCPC Conduct and Competence Committee heard that Mr McShane was convicted at Durham Crown Court of five counts of sexual activity with a child, and two counts of sexual assault. He was sentenced to consecutive terms of imprisonment for six years and one month.

The Panel further heard that the crimes were committed against two teenage girls, who had been in the same theatre club as Mr McShane, and that there were elements of grooming and abuse of trust.

Panel Chair William Nelson commented:

“The Panel is satisfied that the conduct of Mr McShane amounted to serious and deliberate criminal offences which involved sexual abuse over an extended period of time. There is lack of insight and a continuing risk of harm. Mr McShane has shown no ability or willingness to reflect on or change his behaviour. Members of the public would be highly, and rightly, concerned if he were permitted to continue to practise.”

The Panel ordered for the name of Maurice W McShane be struck off the HCPC Register.

Who writes this stuff, Donald Trump?

He's probably already been lined up for the prison podiatrist job, once he's able to sit down comfortably again in a year's time. The NHS has withdrawn prison care in most localities now and private practice is notorious for perverts like this. It's getting almost as bad as the NHS. Better the devil you know...And after he's done time, a steady future as a private podiatry practitioner (unregistered) in an unsuspecting rural location near you...

If the criminal law that convicted him was as deficient as the legislation relied on by the HCPC, he would have been found guilty and sentenced to live in Cornwall under a different name where he could do whatever he liked to kids after that, because the law would be powerless to act as he was now effectively, outside it and untouchable. Only now, he'd get you use his old name again too...probably get a grant for resettlement and hardship at the same time....

Just think - all those civil servants and lawyers and barristers, who are minting it at your expense, know full well these are the consequences of the legislation on the FtP process - and have said sweet Fanny Adams about the risks they've created to the public for the last 14 years. Ever wonder why?

Leith R T Brown has been struck off the HCPC Register on the grounds of misconduct whilst engaged in duties as a physiotherapist at Physiolink, Harrow.

A panel of the HCPC Conduct and Competence Committee heard that Mr Brown attempted to touch Patient A’s breasts and bottom during treatment when it was not clinically necessary.

The Panel further heard that the incident had a significant impact on Patient A, who as a result of the experience has an ongoing mistrust of male practitioners.

Panel Chair William Nelson commented:

“The Panel took the view that this was a very serious incident. It amounted to a sexual assault upon a patient who was in a vulnerable position. It was a clear abuse of trust which had a significant impact upon Patient A. The Panel is satisfied that Mr Brown’s actions would be regarded as deplorable by fellow practitioners and the public at large, and, as such, needs to be marked with an appropriate and proportionate sanction.”

The Panel ordered for the name of Leith R T Brown to be struck off the HCPC Register.

John F Skelton has been suspended from the HCPC Register for a period of nine months on the grounds of misconduct whilst employed as an orthotist at University Hospitals Bristol NHS Foundation Trust.

A panel of the HCPC Conduct and Competence Committee heard that Mr Skelton was responsible for numerous failings relating to five service users, including telling one with cerebral palsy “you don’t have a disability” or words to that effect. He also told another service user that her pain was “psychosomatic” and “why don’t you cut your leg off”.

The Panel further heard that Mr Skelton used racist terminology in the workplace.

Panel Chair Philip Geering commented:

“There were multiple failings by Mr Skelton in terms of different inter-personal relationships, so that despite some positive submissions now being made, the Panel is not confident that he truly comprehends how grave his failings were, nor can it be confident that these would not be repeated in the future. The Panel finds that there is a risk of harm, in failing to work collaboratively with other clinicians and his patients.”

The Panel ordered for the name of John F Skelton to be suspended from the HCPC Register for a period of nine months.

All her training and practice would have reinforced the importance of record keeping, the need for confidentiality and secure records. She failed to safeguard confidentiality and make records of the treatment that she provided to numerous patients. Accordingly, the Panel finds that her professional failings were such as to amount to misconduct.”

The Panel ordered for the name of Jennifer Rankin to be suspended from the HCPC Register for a period of twelve months.

A panel of the HCPC Conduct and Competence Committee heard that whilst employed by Southampton City Council he twice used the council credit card to pay for fuel for his own car. He also breached professional boundaries in that he gave chocolate to Service User A’s mother and did not record the matter correctly.

The Panel further heard that when applying for a role with Borough of Poole as a social worker Mr Tayamoi failed to accurately represent the fact he had previously been employed as a qualified social worker at Southampton City Council.

Panel Chair Polly Clarke commented:

“The Panel considers that the dishonest acts were towards the more serious end of the spectrum. This behaviour brought the profession into disrepute and breached a fundamental tenet of the profession. The Panel finds the risk of repetition to be limited because of the insight demonstrated by Mr Tayamoi. However, the Panel has concluded that, because of the repeated dishonesty, it must find current impairment.”

The Panel ordered for the name of James-Moni Tayamoi to be suspended from the HCPC Register for a period of twelve months.

The Panel further heard that Ms Le Cornu’s failings included flawed assessments, inaccuracies on documentation, poor clinical reasoning in identifying patients’ main problems, basic lack of knowledge and an inability to improve that knowledge, despite a structured development plan put in place by her employer.

Panel Chair Graham Aitken commented:

“The original Panel was of the view that Ms Le Cornu’s actions and omissions placed patients and service users at risk and found that there was no evidence before it to indicate that she had subsequently reflected on her practice so as to achieve sufficient insight into it. This Panel has no information from Ms Le Cornu and therefore no evidence that she has taken steps to address the deficiencies identified.”

The Panel ordered for the name of Marion Hazel Le Cornu to be suspended from the HCPC Register for a further twelve months.

Ms Le Cornu was neither present nor represented at the hearing.
